BackgroundIn its 2015 decision in Montgomery v. Lanarkshire Health Board, the Supreme Court of the United Kingdom overruled the long-standing, paternalistic prudent doctor standard of care in favour of a new reasonable patient standard which obligates doctors to make their patients aware of all material risks of the recommended treatment and of any reasonable alternative treatment. This landmark judgment has been of interest to the rest of the common law world. A judicial trend of invoking Montgomery to impose more stringent (...) requirements on doctors is discernible in subsequent decisions since then.Main bodyIn this narrative review, without questioning the idea that properly informed patients should play a more active role in procedures affecting their own health in furtherance of their autonomy, safety, and consumer rights, we identify and analyse, with the aid of realistic clinical thought experiments, three practical conundrums that the Montgomery standard may inflict on the daily work of doctors, unfairly exposing them to arbitrary legal risks.ConclusionsThese conundrums pertain to the ascertainment of the risks that must be disclosed to the patient under the test of ‘materiality’; the legal uncertainty as to the scope of the exceptions; and the actual ability of doctors to cope with the pressures of time. These conundrums offer ripe opportunities to rethink the proper role of judicially developed medical law in modern health care practice. (shrink)

In 1884 Sir William Thomson (later Lord Kelvin) delivered a significant series of lectures on physics at the Johns Hopkins University in Baltimore. This book presents the twenty lectures in their original form for the first time.

In this essay Kelvin Beckett argues that Richard Peters's major work on education, Ethics and Education, belongs on a short list of important texts we can all share. He argues this not because of the place it has in the history of philosophy of education, as important as that is, but because of the contribution it can still make to the future of the discipline. The limitations of Peters's analysis of the concept of education in his chapter on “Criteria (...) of Education” are well known. In the chapter on “Education as Initiation,” however, Peters offered a synthetic sketch of education that, Beckett argues, points us toward a more comprehensive definition of education, one which, he maintains, can be accepted by all philosophers, regardless of the tradition they work in. The last millennium saw rapid change, spreading globalization, and shifting populations. These have posed moral, ethical, and social dilemmas that have challenged the very foundations of our beliefs and radically changed our way of life. In this volume, some of the world's greatest thinkers in philosophy, music, religion, and the arts share their insights on the future shape of human civilization. How can old cultural legacies fit new contexts? Can there be a universalist values coexist with local differentiation? Are literature (...) and music still relevant in a world where technology is dominant? Does consciousness collapse the quantum wave function? This idea was taken seriously by John von Neumann and Eugene Wigner but is now widely dismissed. We develop the idea by combining a mathematical theory of consciousness (integrated information theory) with an account of quantum collapse dynamics (continuous spontaneous localization). Simple versions of the theory are falsified by the quantum Zeno effect, but more complex versions remain compatible with empirical evidence. In principle, versions of the theory can be tested by experiments with (...) quantum computers. The upshot is not that consciousness-collapse interpretations are clearly correct, but that there is a research program here worth exploring. (shrink)

Children who grow up with a life‐threatening illness live and face death in a way that is foreign to those of us who have reached adulthood in relative health. The experiences that form their identities create a range of knowledge, and processes for acquiring that knowledge, quite apart from the mainstream. In the pace of its acquisition, and the depth of its content, this knowledge is hard for the rest of us to comprehend. Indeed, the primary symptom of this alternate (...) cognizance is that it sets these children apart from their families, peers, and greater communities. The child as a whole is marginalized in interpersonal relations by essentializing the child as the illness. The experience of the illness itself further isolates the child.Through firsthand observation, we find that the Hole in the Wall Gang summer camps provide a nearly unique environment for the normalization of this alternate cognizance. At camp, all those things that set them apart from the rest of the world mark them as normal members of a society. Other children share their physical qualities, have similar experiences and immediately understand their perspective on life. Small adjustments to social and physical environments have a lasting effect. A warm pool to swim in, a caring touch, an open smile—the children take the memory of these with them when they leave. They begin to understand that they are a desired part of a large and varied community. A new definition of normal is created and they are included. (shrink)

Thomson, Kelvin You might be surprised to learn that China, home of the much derided one-child policy, has a higher birth rate than Italy, home of the Vatican. This suggests Chinese families are quietly defying their political leaders and Italian families are quietly defying their religious ones. But the overall global picture is one of rapid population growth.

What makes some firms more innovative than others and what determines the source of these innovations are questions that are still not adequately answered due to the complex, often esoteric, nature of the innovation process. This paper considers the effect of one externally oriented strategy (extent of formal inter-organizational linkages) and one internally oriented strategy (degree of knowledge intensity) on overall levels of innovativeness and the source of these innovations. Using data collected from firms operating in the bioscience-technology industries in (...) both New York and Utah, our results suggest that both of these strategies have a significant effect upon innovation levels and the source of innovation (internally versus externally stimulated). Interestingly, there were few firms that undertook both of these strategies simultaneously and thus the proposed interaction effect where increased absorptive capacity (on the basis of knowledge intensity) would make external linkages even more valuable could not be discerned. The primary quantum mechanical equation of motion entails that measurements typically do not have determinate outcomes, but result in superpositions of all possible outcomes. Dynamical collapse theories (e.g. GRW) supplement this equation with a stochastic Gaussian collapse function, intended to collapse the superposition of outcomes into one outcome. But the Gaussian collapses are imperfect in a way that leaves the superpositions intact. This is the tails problem. There are several ways of making this problem more precise. But many authors dismiss (...) the problem without considering the more severe formulations. Here I distinguish four distinct tails problems. The first (bare tails problem) and second (structured tails problem) exist in the literature. I argue that while the first is a pseudo-problem, the second has not been adequately addressed. The third (multiverse tails problem) reformulates the second to account for recently discovered dynamical consequences of collapse. Finally the fourth (tails problem dilemma) shows that solving the third by replacing the Gaussian with a non-Gaussian collapse function introduces new conflict with relativity theory. (shrink)

We defend the many-worlds interpretation of quantum mechanics against the objection that it cannot explain why measurement outcomes are predicted by the Born probability rule. We understand quantum probabilities in terms of an observer's self-location probabilities. We formulate a probability postulate for the MWI: the probability of self-location in a world with a given set of outcomes is the absolute square of that world's amplitude. We provide a proof of this postulate, which assumes the quantum formalism and two principles concerning (...) symmetry and locality. We also show how a structurally similar proof of the Born rule is available for collapse theories. We conclude by comparing our account to the recent account offered by Sebens and Carroll. (shrink)

This paper is a review of words and their meanings in the field of technology studies, and an analysis the semantics of an idealistic international technology-related social movement that flourished briefly during the second half of the twentieth century. Sloppy nomenclature employed by proponents and observers of the movement led to people with opposite views appearing to agree (and vice versa), with the consequence that the movement’s valuable policy insights exerted only marginal influence on mainstream technology policy. I conclude that (...) poor technological semantics may undermine effective technological practice. Suggestions for a constructive technological nomenclature are presented. (shrink)

William C. Frederick proposes a naturalistic business ethics. Many commentators focus on the issues of naturalistic fallacy, deprivation of freedom of the will, and possibility of important and universal moral values in business ethics. I argue that an ethics being naturalistic is not a worry. The issue of deprivation of free will is irrelevant. Yet there are urgent questions regarding the possibility of important and universal moral values, which may prevent Frederick’s view from getting off the ground.

In a 1988 study, James T. C. Liu used the phrase "China turning inward" to characterize the shift from Northern Song to Southern Song intellectual traditions, especially the intellectual lineage from Cheng Yi 程頤 to Zhu Xi 朱熹.1 Building upon Professor Liu's characterization, I will explore more specifically how the Way turned toward greater emphasis on inner self-cultivation as daoxue 道學....

The propositions that the senses are separate and that the global array may be sufficient for adequate perception are questioned. There is evidence that certain tasks may be primarily but these are a special case along the behavioral continuum. Many tasks involve sensory information that is ambiguous, and other sources of information may be required for adequate perception.

Aristotle is the most influential philosopher of practice, and Knight's new book explores the continuing importance of Aristotelian philosophy. First, it examines the theoretical bases of what Aristotle said about ethical, political and productive activity. It then traces ideas of practice through such figures as St Paul, Luther, Hegel, Heidegger and recent Aristotelian philosophers, and evaluates Alasdair MacIntyre's contribution. Knight argues that, whereas Aristotle's own thought legitimated oppression, MacIntyre's revision of Aristotelianism separates ethical excellence from social elitism and justifies resistance. (...) With MacIntyre, Aristotelianism becomes revolutionary. MacIntyre's case for the Thomistic Aristotelian tradition originates in his attempt to elaborate a Marxist ethics informed by analytic philosophy. He analyses social practices in teleological terms, opposing them to capitalist institutions and arguing for the cooperative defence of our moral agency. In condensing these ideas, Knight advances a theoretical argument for the reformation of Aristotelianism and an ethical argument for social change. (shrink)

Integrated information theory is a theory of consciousness that was originally formulated, and is standardly still expressed, in terms of controversial interpretations of its own ontological and epistemological basis. These form the orthodox interpretation of IIT. The orthodox epistemological interpretation is the axiomatic method, whereby IIT is ultimately derived from, justified by, and beholden to a set of phenomenological axioms. The orthodox ontological interpretation is panpsychism, according to which consciousness is fundamental, intrinsic, and pervasive. In this paper it is argued (...) that both components of the orthodox interpretation should be rejected. But IIT should not be rejected since an interpretation-neutral formulation is available. After explaining the neutral formulation, more plausible non-axiomatic epistemologies are defended. The neutral formulation is then shown to be consistent with various contemporary physicalist ontologies of consciousness, including the phenomenal concept strategy, representationalism, and even illusionism. Along the way, instructive connections between interpretations of IIT and interpretations of quantum mechanics are noted. (shrink)

The many worlds interpretation of quantum mechanics (MWI) states that the world we live in is just one among many parallel worlds. It is widely believed that because of this commitment to parallel worlds, the MWI violates common sense. Some go so far as to reject the MWI on this basis. This is despite its myriad of advantages to physics (e.g. consistency with relativity theory, mathematical simplicity, realism, determinism, etc.). Here, we make the case that common sense in fact favors (...) the MWI. We argue that causal explanations are commonsensical only when they are local causal explanations. We present several quantum mechanical experiments that seem to exhibit nonlocal “action at a distance”. Under the assumption that only one world exists, these experiments seem immune to local causal explanation. However, we show that the MWI, by taking all worlds together, can provide local causal explanations of the experiments. The MWI therefore restores common sense to physical explanation. (shrink)

This book approaches the topic of intercultural understanding in philosophy from a phenomenological perspective. It provides a bridge between Western and Eastern philosophy through in-depth discussion of concepts and doctrines of phenomenology and ancient and contemporary Chinese philosophy. Phenomenological readings of Daoist and Buddhist philosophies are provided: the reader will find a study of theoretical and methodological issues and innovative readings of traditional Chinese and Indian philosophies from the phenomenological perspective. The author uses a descriptive rigor to avoid cultural prejudices (...) and provides a non-Eurocentric conception and practice of philosophy. T'ang Chün-i's early work Ai-ching chih fu-yin (Gospel of love) has been much neglected by T'ang scholars. This essay argues that this text is not a caprice, and that it marks an important stage in T'ang's life and studies. Furthermore, in the history of Chinese philosophy, it is probably the first book ever written on the philosophy of love.

This study uses a Marxist perspective to investigate Hong Kong students’ alienation from learning. Alienated learners find learning to be a meaningless, disempowering, and estranging activity. Fifteen Hong Kong undergraduate students were invited to join a photovoice project in which they actively took, shared, and discussed photographs of their experiences with learning. The results suggest that social beliefs about high-stakes examinations legitimize internal contradictions in the education system. This makes students uncritically and unreflectively accept alienated learning. Photovoice projects help the (...) students to become critically aware of their position, self-determination, and agency. (shrink)

Social practices are widely regarded as the bedrock that turns one’s spade, beneath which no further justifications for action can be found. Followers of the later Wittgenstein might therefore be right to agree with Heideggerians and neo-pragmatists that philosophy’s traditional search for first principles should be abandoned. However, the concept of practices has played a very different role in the philosophy of Alasdair MacIntyre. Having once helped lead the assault on foundationalism in both moral and social philosophy, his elaboration of (...) an Aristotelian’ concept of practices in After Virtue has since led him to embrace a metaphysical teleology. This paper attempts to outline MacIntyre’s Aristotelian concept, and to identify its ethical, political and philosophical significance. (shrink)

The principle of mass additivity states that the mass of a composite object is the sum of the masses of its elementary components. Mass additivity is true in Newtonian mechanics but false in special relativity. Physicists have explained why mass additivity is true in Newtonian mechanics by reducing it to Newton’s microphysical laws. This reductive explanation does not fit well with deducibility theories of reductive explanation such as the modern Nagelian theory of reduction, and the a priori entailment theory of (...) reduction that is prominent in the philosophy of mind. Nonetheless, I argue that a reconstruction of the explanation that incorporates distinctively philosophical concepts in fact fits both theories. I discuss the implications of this result for both theories and for the reductive explanation of consciousness. (shrink)
